• Dealer is liable to accept the order of product available and provide the tracking data in the dashboard provided by BestBy+ for live tracking to customers and BestBy+.
  • Business Hours defined will be 10 AM to 9 PM for All day in Week.
  • Delivery charges has to be borne by the Dealer.
  • The material should be properly packed in a manner that no damage/breakage is incurred during transit and Dealer will be liable for any such damage and in no case, the damaged Package will be delivered to customer.
  • Before packing and delivery, the Dealer has to match the serial number, Color, Pricing, Specifications mentioned on the label affixed on the product with customer purchase order and shipping label.
  • Shipping labels will be generated with customer details and cater to specific demand with gift pack/gift card if requested by customer.
  • Invoice will be generated through the dealer. The invoice contains the buyer’s and the dealer’s name, and payment details. Invoice should be in triplicate form: First copy would be inside the invoice pouch of the package, Second copy would be inside the package and Third copy would be for the dealer.
  • BestBy+ usually advises against cancellation of any order as it hampers customer experience, however in case it is unavoidable circumstances – click on cancellations in the dealer dashboard, click cancel along with valid reason for the cancellation and cancel the order. Choosing a cancellation option can be disappointing for a customer, so choose wisely.
  • Dealer will follow all the government norms of the Motor Vehicle Act, 2018 while delivering the product and will be responsible for any government Action for the failure of following the rules.
  • Dealer shall be solely responsible to deliver/dispatch the product/s within One (1) Hour of Working time from date of receipt of Order from BestBy+ as per the time stipulated in the Online Portal. In case, Dealer fails to deliver the product in whole within the specified time, all orders will stand automatically terminated by BestBy+ and will affect the dealer Ranking.
  • Dealer or Delivery Partner will be liable to legal action or penalty as levied by BestBy+ in case of any aggressive, confrontational, and harassing behavior with customers.
  • Dealer shall provide the details of stock / inventory / current offers of all Products, on day to day basis, in the electronic / other form as may be prescribed by BestBy+ (from time to time), so that only those products are listed whose stock is available with Dealer.
  • Dealer agrees and undertakes that the Product/s dispatched/delivered by Dealer are accompanied with invoice, delivery challans, guarantee card, instruction manuals, free materials, etc. including all other relevant documents as required under statutory and governmental regulations in India and Internationally, on case to case basis. Dealer agrees to provide actual proof of dispatch and other related documents, to www.bestbyplus.in, as sought by BestBy+, and the dealer further agrees and undertakes that on their failure to comply with the above-mentioned obligations, BestBy+ shall not be liable in any manner whatsoever for such non-compliance.
  • Dealer will be solely responsible to settle all and any issues directly with the customer, within 24 hours to the satisfaction of BestBy+ as well as the customer, without involving BestBy+ in any manner, whatsoever.
  • The Dealer further undertakes that the Firm (BestBy+) has no relation as to money (charge) with the end customers and their agreement is only with the dealer, therefore the Firm will only facilitate the sale-purchase of the customers and they in turn purchase from the dealers.
  • In case, any complaint, with respect to the product of the Dealer is received from a customer, including late delivery, quality of the product, defective product, etc., Dealer shall be liable to give compensation / 100% free replacement / refund for dishonoring of commitments, made by using BestBy+ Online Platform. The amount of compensation/costs or penalty, if any is imposed on the Firm due to any act of the Dealer and if the Firm is made to refund any amount to the Customer, the same will be borne the Dealer alone, for which, the payment due to the Dealer by BestBy+ will reduced by the said amount.
  • Dealers are requested to make sure collect the filled delivery sheet / acknowledgement and note down the condition of the delivered package.
  • If the estimated delivery time has passed and customer has not received the package, Dealer needs to contact customer for reasoning the delay and update BestBy+ about the same.
  • While collecting the return product from the customer, dealer has to check the package for any visible physical damage before accepting.
  • Due to COVID-19 outbreak in the world, hygiene is compulsory to be followed by the dealer network and the delivery partner. They have to make sure that each and every person whosoever is going to deliver the product to the customer, has wearing a mask, using an alcohol-based sanitizer and can practice social distancing. If it is come to the notice of BestBy+ that partners are not following hygiene practice then it will be affected on Dealer Ranking.
  • 21) Dealer shall indemnify, hold harmless, and defend BestBy+ and its Affiliates and licensees, and their respective directors, officers, employees, and agents (the “BestBy+ Indemnitees”) from and against any claims, suits, actions or proceedings brought by a Third Party or Customer (collectively, “Claims”) against any BestBy+ Indemnitee, recoveries payable to a Third Party claimant and any reasonable attorneys’ fees and costs of litigation incurred by a BestBy+ Indemnitee in connection therewith, to the extent resulting from or arising out of (a) dealer’s breach of any warranty or other provision of the Agreement; (b) the negligence or intentional misconduct of Dealer, its employees, officers, agents or representatives or by the Delivery partners. Dealer shall indemnify, defend and hold harmless “BestBy+” affiliates, and its and their directors, officers, employees and agents, from and against any and all claims, losses, liabilities, lawsuits, proceedings, costs and expenses, including, without limitation, attorneys’ fees arising out of or in connection with the agreement.
  • Each of the parties herein agree that: If any dispute, difference, controversy or claims arising out of or relating to this Agreement or the breach, the Parties shall attempt, for a period of thirty (30) days from the receipt of a notice from the other Party of the existence of a dispute, to settle such dispute by mutual discussions between the Parties. If the dispute cannot be settled by mutual discussions within the thirty (30) day period provided above, either Party may refer the matter for Arbitration. The arbitration proceedings shall be held under the provisions of the Arbitration and Conciliation Act, 1996 or any of its subsequent amendments. The place of arbitration shall be Ahmedabad. The arbitral procedure shall be conducted in the English language. The award of the arbitral tribunal shall be final, conclusive and binding upon the Parties, and the provisions of the [Indian] Arbitration and Conciliation Act, 1996 shall apply. The rights and obligations of the Parties under, or pursuant to, this Clause, including the arbitration agreement in this Clause, shall be governed by and be subject to Indian law and subject to above the Courts at Ahmedabad shall have exclusive jurisdiction over any disputes under this Agreement.
  • You hereby expressly agree to receive Promotional/Non-Promotional communications by way of Calls, SMSs and/or e-Mails from BestBy+ and its affiliates, agencies, etc. You can unsubscribe/opt-out from receiving communications through Calls, SMSs and/or e-Mails anytime by contacting us for the same. However, you may still receive Promotional/Non-Promotional communications from Your end with respect to Your use of the BestBy+ Service.
  • BestBy+ reserves the unconditional right to modify or amend this Terms of Use without any notification. The Dealer has to determine when this Terms were last modified by referring to the “Last Updated” legend above. It shall be dealer’s responsibility to check this Terms periodically. Your acceptance of the amended Terms shall signify the consent to such changes and agreement to be legally bound by the same.
  • BestBy+ reserves the right to suspend or terminate Your Account and refuse any and all current or future use of the Platform (or any portion thereof) at any time.
